Cooperation agreement between : the International Office of the Allotment gardeners and the Association for Japan Allotment Garden
Between the Office International du Coin de Terre et des Jardins Familiaux a.s.b.l. represented by its acting executive board and the Association for Japan Allotment Garden represented by its President Yoshiharu MEGURIYA and its secretary general Yoshinori KASUYA the following cooperation agreement has been concluded :
Aim :
The cooperation agreement is concluded with the aim to reinforce the friendly links between the Japanese and European allotment gardeners, to allow the intensification of a constructing exchange of views between the parties and to stimulate the development of the allotment garden movement in Japan.
Rights and obligations :
The leisure garden federations linked to the Office with a cooperation agreement have the right:
- to take part in the international congresses
- to receive the review: the Hyphen issued twice a year
- to take part in a yearly exchange of ideas with the executive board
- to receive, within the limits of the competences of the Office, help and support by the Office and its members
These federations have as obligations:
- to observe the aims, statutes and internal regulation of the Office. The statutes and the internal regulation that are joined as appendix form an integral part of this agreement
- to pay the affiliation fee fixed by the general assembly
- to inform the Office once a year on the evaluation of the leisure garden movement in their country
- to send their reviews to the Office
Affiliation fee :
The yearly affiliation fee is fixed every year by the general assembly of the International Office in accordance with the applicable regulation.
The Japanese allotment gardeners are informed on the decision within the 6 weeks following this general assembly.
The affiliation fee is payable every year before March 31st.
Term :
The cooperation agreement enters into force on March 17th 2007. It is concluded for the term of one year.
If it is not resiliated by registered letter 2 months before its normal end, it continues automatically from year to year.
Termination of the cooperation agreement
The cooperation agreement is considered as terminated if the Japanese federation refuses to pay the annual affiliation fee within the term fixed by the agreement and that after written reminder sent 2 months after the normal deadline it does not comply with its obligation.
The general assembly can vote an anticipated end of the cooperation agreement with a 2/3 majority of the votes expressed if the Japanese federation countermines to the aims and interests of the Office.
The executive board acknowledges the automatic termination or the anticipated end of the agreement and informs the federation in writing of this fact.
Working languages
The official languages of the Office are French, English and German.
Legislation and competent jurisdiction
The Luxembourg laws are applicable.
The Luxembourg courts are competent in case of litigation.
